Federal law requires you to notify the Centers for Medicare and Medicaid Services (CMS) if your group prescription drug coverage for Medicare beneficiaries is creditable. CMS requires you to submit a
Creditable Coverage Disclosure Form each year or upon any change that could affect whether the drug coverage offered is creditable.
You must complete the disclosure form and submit it to CMS within 60 days after the start date of your plan year. The form can be completed online and submitted electronically
Only one disclosure form for each tax ID number is required for each employer group, as long as the plan year is the same for all subsidiaries and divisions. If your group is approved for the Retiree Drug Subsidy (RDS), you are exempt from filing the disclosure form because the RDS application serves as the disclosure to CMS.
